1. Acceptance of Terms

By accessing or using the Pet Ritual App (“App”), you agree to be bound by these Terms & Conditions (“Terms”).

If you do not agree, you must not use the App.

2. Definitions

  • “Company”: Animal Deluxe Trading LLC
  • “User”: Any individual using the App
  • “Groomer”: Professional user managing pet/client data
  • “Services”: Features, tools, recommendations, and content within the App

3. Eligibility

You must be at least 18 years old to use the App.

By using the App, you confirm that:

  • You have legal capacity to enter into binding agreements
  • You comply with applicable laws

4. Account Registration

Users must:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Notify us of unauthorized access

We reserve the right to suspend or terminate accounts for violations.

5. Nature of the Service

The App provides:

  • Grooming guidance
  • Product recommendations
  • Pet care insights

Important:

  • The App does NOT provide veterinary advice
  • Content is informational only

Users remain fully responsible for decisions taken.

6. Groomer-Specific Terms

Groomers agree that:

  • They act as independent professionals

  • They are solely responsible for:

    • Client relationships
    • Data entered into the App
    • Services provided to their clients

The Company does not assume liability for groomer services.

7. User Obligations

Users agree NOT to:

  • Use the App for unlawful purposes
  • Input false or misleading data
  • Upload harmful, abusive, or infringing content
  • Attempt to access systems without authorization

8. Intellectual Property

All content in the App (including branding, design, text, algorithms):

  • Is owned by or licensed to the Company
  • Is protected under applicable intellectual property laws

Users may not copy, distribute, or exploit content without permission.

9. User-Generated Content

Users (including groomers) retain ownership of their content.

However, by uploading content, you grant the Company a:

  • Worldwide
  • Non-exclusive
  • Royalty-free license

to use, display, and process such content for operating the App.

10. Data Protection

Personal data is processed in accordance with our Privacy Policy.

By using the App, you acknowledge:

  • Data processing as described
  • Profiling for recommendations
  • Consent where applicable

11. Third-Party Services

The App may include links or integrations with third-party services.

We are not responsible for:

  • Their content
  • Their data practices
  • Their services

12. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for:

  • Indirect or consequential damages
  • Loss of data or business
  • Decisions made based on App recommendations

The App is provided “as is” and “as available.”

13. Indemnification

Users agree to indemnify and hold harmless the Company against claims arising from:

  • Misuse of the App
  • Breach of these Terms
  • Violation of applicable laws

14. Termination

We may suspend or terminate access if:

  • Terms are violated
  • Legal obligations require it

Users may terminate their account at any time.

15. Governing Law & Jurisdiction

These Terms are governed by:

  • Laws of the United Arab Emirates

Disputes shall be resolved in:

  • Dubai Courts, unless otherwise required by applicable law

16. Changes to Terms

We may update these Terms at any time.

Continued use constitutes acceptance of the updated Terms.

GROOMER DATA PROCESSING AGREEMENT (DPA)

Pet Ritual App – B2B Compliance Framework

1. Parties

This Data Processing Agreement (“DPA”) is entered into between:

  • Animal Deluxe Trading LLC (“Platform”)
  • Groomer / Pet Business User (“Groomer”)

2. Roles of the Parties

2.1 Groomer = Data Controller

The Groomer determines:

  • What data is collected
  • Why it is collected
  • How it is used

2.2 Platform = Data Processor

The Company processes data:

  • On behalf of the Groomer
  • For providing App functionality

3. Subject Matter

Processing of client pet-related data within the App.

4. Categories of Data

  • Pet owner name (if entered)
  • Contact details (optional)
  • Pet profiles
  • Grooming history
  • Skin and coat condition data

5. Purpose of Processing

  • Managing grooming records
  • Generating recommendations
  • Supporting grooming workflows

6. Groomer Obligations (CRITICAL)

The Groomer shall:

6.1 Lawful Basis

Ensure a valid legal basis under GDPR/UAE PDPL, including:

  • Explicit consent from pet owners

6.2 Transparency

Inform clients about:

  • Data usage
  • Storage in the App

6.3 Data Accuracy

Ensure all data entered is accurate and up to date

6.4 Data Minimization

Only collect data necessary for grooming services

7. Platform Obligations

The Platform shall:

  • Process data only on Groomer instructions
  • Implement appropriate security measures
  • Ensure confidentiality
  • Assist with data subject rights requests

8. Sub-Processors

The Platform may use third-party providers (e.g., cloud hosting).

We ensure:

  • Contractual safeguards
  • Data protection compliance

9. International Transfers

Data may be transferred outside the UAE/EU.

Safeguards include:

  • Standard Contractual Clauses
  • Equivalent protection mechanisms

10. Data Security

Measures include:

  • Encryption
  • Secure hosting
  • Access control

11. Data Breach Notification

In case of a breach:

  • Platform will notify Groomer without undue delay
  • Groomer is responsible for notifying affected clients (if required)

12. Data Retention & Deletion

Upon termination:

  • Data will be deleted or anonymized
  • Unless legal obligations require retention

13. Data Subject Rights

The Platform will assist Groomers in responding to:

  • Access requests
  • Deletion requests
  • Correction requests

14. Liability

Each party is responsible for:

  • Its own compliance obligations

The Groomer bears responsibility for:

  • Lawful data collection
  • Client consent

15. Indemnification

The Groomer agrees to indemnify the Platform for:

  • Unlawful data collection
  • Missing consent
  • Misuse of personal data

16. Governing Law

This DPA is governed by:

  • UAE law

17. Acceptance

By using the App in a professional capacity, the Groomer:

  • Accepts this DPA
  • Confirms compliance with data protection laws
